$345,000.00 Jury Verdict for Unoperated Cervical Disc
Plaintiff, a 58 year old employee at the
Sheriff’s Office was broad-sided on her way back from lunch by a
teenager going the wrong way on a one way street.
Plaintiff’s head broke the driver’s side window
and as a result she suffered severe neck strain, eventually
diagnosed a bulging cervical disc.
By the time of trial, plaintiff had undergone a
full regimen of conservative treatment. Her treating physician
certified that his best advice was ultimately a disc fusion which
would avoid more severe future problems but not eliminate her pain.
Defendant argued for comparative fault for
failure to keep a proper lookout, and that the injury was
pre-existing and the wreck caused a soft tissue sprain.
The unanimous jury award found 100% fault on the
defendant and awarded $345,000
for plaintiff’s injury.
